Surrogacy is legal in Oregon. Like most states, Oregon has little law regarding surrogacy. However, Oregon courts have acknowledged surrogacy and created legal relationships between intended parents and their children for over 20 years.
How you establish parental rights will depend on your specific circumstances, including whether you are genetic parents or working with a donor, and whether your surrogate is married. Advantages of an Oregon Surrogacy:
While Washington shares a forward thinking and accepting social climate with Oregon, the law regarding surrogacy has not yet caught up to public opinion. At this time, it is illegal to compensate a surrogate in a Washington surrogacy. In 2011 the legislature attempted but failed to pass a bill that would have made compensating surrogates legal. We are hopeful the bill will be reconsidered with more success in the future.
